Access to and use of this Website (hereinafter “Site”) and the products and services available throughout this Website (collectively referred to as the “Services”) are subject to the following terms, conditions and notes (the “Terms & Conditions”). By using this Site and its Services, you (the user) are agreeing to all of the Terms & Conditions, as may be updated from time to time. Please read the Terms & Conditions carefully and check this page regularly to monitor any changes. If you do not agree to the Terms & Conditions, you should not use the Services of this Site. If you do not agree to any change to the terms, then you should stop using the site. The site operates in English and Greek language.

Any changes made after you have placed an order will not affect that order, unless we are obliged to make the change by law.

Christiana Kafa (or “we” or “us” or “our”), which operates the online shop www.christianakafa.com is the trading name of Christiana Kafa, a company registered in Greece under the GEMI no. 150342703000. These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by Christiana Kafa. Nothing said by any sales person on our behalf should be understood as a variation of these Terms & Conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. We shall have no liability for any such representation being untrue or misleading.

Christiana Kafa makes every possible effort in order to guarantee that the information included in the content of this site is complete, accurate, explicit, valid, informative, updated, truthful and non – misleading. In any case we bear no responsibility for or any commitment neither we guarantee the safety of the content. Our users accept the fact that we may not be able to control the entire content and all its Services. Moreover, we do not guarantee that the use by its users of the information, data and material included in the content of this site will not infringe the rights of third persons.

This site also contains links to other websites (hyperlinks or banners), which are not managed by Christiana Kafa. We have no control over the linked sites nor the Services provided or the personal data protection policy applied by them. The use of the linked sites will be subject to the terms of use contained within each such site, for the content of which the users shall get informed. We bear no responsibility for any loss or damage that may arise from the use of those websites. Each user who makes use of the linked sites is responsible for this use.

This site does not address to minors. If nevertheless minor users access the Services of Christiana Kafa that are considered inappropriate for minor users or visit on their own initiative sites with inappropriate/offensive/unethical content and which cannot be continuously monitored by Christiana Kafa, we bear no responsibility.

Users are personally responsible for the use of this site and for all their activities on this site. The user is solely responsible for any post, publication, mailing, transmission or generally for everything made available through our Services. Users also bear sole responsibility for the possession and maintenance of the telephone connections, computers and the equipment in general necessary for the use of our Services.

If a user violates the terms, his/her access to this site on a temporary or permanent basis may be denied at Christiana Kafa discretion. In case we notice any content that causes damage to a third party, we reserve the right to delete immediately the content as well as to suspend the function of the user account that violates the present terms.

  1. REGISTERING WITH OUR SITE

Users are required to sign up in order to make the most of the services and features available in our site. Upon registration, you will be asked to provide your true, current, accurate, full personal information (first name, last name, email address, billing and shipping address). Users also agree to keep and diligently update the registered data in order for them to be true, accurate, valid, updated and complete. The account password you may choose – in case you wish to change the password which is sent to you upon registration – should be unique and kept secure and you must notify us immediately of any breach of security or unauthorized use of your account. Users are solely responsible for all the acts realized under their password, their username and generally their user account as well as for the proper use of their account, while the Company bears no responsibility for any loss or damage may arise from the incapability of the users to follow and respect the present terms.

On the top right corner on every page throughout the site you can find the ‘Menu’ button where you can find ‘My Account’ and ‘Wishlist’ links. When you open the ‘My Account’ page, you are prompt to fill in either your login details (username or email and password) or your email address in order to register. By clicking ‘Register’ you automatically create an account on our site. As soon as you register on our site, an email will be delivered to the registered email address that you provided with the subject line: ‘Your Christiana Kafa account has been created!’ in which you will find your username and an automatically generated password for your first login in your account. You may later on change this password on ‘My Account’. The new password should be at least twelve characters long and to make it stronger, you may use upper and lower case letters, numbers and symbols.

From your account dashboard you can:

  • view your orders,
  • manage your shipping and billing addresses,
  • automatically have your shipping details filled out each time you make an order
  • edit your password,
  • edit your account details,
  • log out from your account
  1. GETTING READY FOR YOUR PURCHASE

To make purchases on this Site, you will be required to provide your personal details, such as your full name, phone number, e-mail address, billing address and other requested information, according to the form provided on our Site. By submitting an order to us, you represent and warrant that the provided details are both valid and correct and that when your order is accepted and processed by us, payment will be made in full. By placing an order, you confirm that you are the person referred to in the Billing details.

If you are under 18 years of age, please do not register with this Site. Under no circumstances, we will not accept orders from those under 18.

You are eligible to use this Site if you:

– have agreed to the Terms & Conditions of the Site.

– have been issued a valid credit/debit card by a bank acceptable to Christiana Kafa.

– have authorized us to process a charge or charges on their credit/debit card in the amount of the total purchase price for the ordered products.

  1. ORDERS

All orders are subject to acceptance and availability, which means that items in your cart are not reserved and are available to other customers until the completion of your purchase. You can check the availability of a product by clicking on it; by doing so, you are immediately redirected to a new page where you may view the details of the product: description, price, availability, product code; the option to choose the size that suits you, the quantity and either add the product to your cart or to your ‘Wishlist’.

If you wish to order a product, you have to select size and quantity and add the product in the cart. By clicking ‘Add to cart’ the number of products in your cart is visible next to the icon on the top right of every page in the site. By clicking on the cart button you can either update the cart (such us remove any of the products or change the quantity with the arrow buttons) or checkout.

When you click on the checkout button, you are redirected to the checkout page where you can add discount coupons, fill in your billing and shipping details (if different to the billing details) and add order notes. If you are a registered user and you have already registered this information on ‘My Account’, these fields will be automatically filled in. Your payment options are also visible on the checkout page. In order to complete your order you are required to accept the website terms & conditions. Delivery costs are not included in the products price, but will be calculated and presented to you before the final payment. Once you agree with the terms and make sure you have properly filled in the required fields you can press the ‘Place order’ button. You will be redirected to a page with the summary of your order. You will also receive a confirmatory e-mail with the subject line: “Your Christiana Kafa order has been received!” containing all the information regarding your order: Christiana Kafa bank details, your order number and date of order, description of product, quantity and price, shipping details, payment method, optional notes and your registered billing address.

Regarding the payment methods the below options are available:

Once we have successfully received your payment and as soon as we start processing your order, you will receive this email from us: “Payment received for your order”. As soon as the order is completed, you will be notified with another email: “Your Christiana Kafa order is now complete”.

You will be able to follow the shipping of your Christiana Kafa piece of jewellery with a tracking code that you will receive in a note in your order and the following message will appear: “Note added to your Christiana Kafa order”.

You can choose between the following delivery options:

– Courier service (delivery is free for orders in Greece, whereas for shipping outside Greece, fees are calculated depending on destination country)

– Pick-up option (available only after appointment with us).

Christiana Kafa will retain your order agreement for future use, such as for proof of agreed terms of sale, selected product(s) etc.

We reserve the right to cancel your order if one of the following occurs:

– Your payment is not authorized.

– There is no delivery service available in your location.

– You don’t agree to the Terms & Conditions of our site.

– One or more of the ordered items was listed at an incorrect price due to a typographical error.

  1. CANCELATION

If you wish to cancel your order, please inform us via e-mail on [email protected] within one (1) hour from the completion of your order or call on +302109825301. Please be sure to include your order number and personal details in your request. You will be notified on when you will be reimbursed if you have already made the payment. Once an order has been shipped we are unable to cancel it.

  1. PAYMENTS POLICY

All our transactions are in Euros (€). You will be billed in Euros. If you are a customer whose credit/debit/prepaid card is not denominated in Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Please note, that if you purchase from a country which has other currency than Euros, then currency fluctuations and credit card charges may make a difference to the amount billed on your credit/debit card.

Regarding the payment methods the below options are available:

  1. DELIVERY

All orders in Greece are delivered within 3-5 business days. For products Upon Request delivery time is 15-20 working days. International deliveries depend on final destination.

All Greece orders ship with SPEEDEX Courier. Delivery is free for shipping in Greece. All international orders ship with DHL Express. Delivery periods vary according to the destination. Shipping costs depend on destination country and will be calculated and present to you before the final payment.

Orders are not shipped or delivered on weekends or Greek public holidays.

* Non EU-Customers shall be subject to any charges that may arise from exchange rate differences, customs clearances, etc., for which our company shall bear no liability.

  1. INSURANCE & DELIVERY

We insure each purchased product during the time it is in transit until it is delivered to the shipping destination. In case the delivery falls through due to the courier’s fault, we arrange a new delivery within 3-5 business days with no extra charge whatsoever.

All our products are provided to you in a special packaging that ensures that they will get to you absolutely secured and at excellent condition. If you have detected that your package is tainted or tampered with, Christiana Kafa does not take responsibility. Please contact us to arrange a replacement for your order.

We are not to be held liable or responsible for any failure to deliver your order caused by events outside our reasonable control (‘Force Majeure’ clause).

Deliveries will be made by the carrier to the address indicated in your order. It is your responsibility to ensure that the delivery address you provide us is correct, accurate and updated.

If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

  1. RETURNS

You have the right to withdraw from the purchase contract, without having to announce the reason why you want to return the products, within fourteen (14) calendar days after the products have been delivered to you. The return policy applies for example in case that you are simply not satisfied with the product you received and you would like to return it and possibly proceed with the purchase of another one from our site. This suggests that you will have to make your decision clear to us before the end of the 14th day as stated above. Make sure you fill out the Withdrawal Form you will find here or at the footer of our Site’s homepage and send it via e-mail at [email protected] in order to let us know that you wish to withdraw from your purchase before you return the product(s).

As soon as we receive your email with your decision to withdraw, you will receive a confirmation email by us; please make sure that you have our confirmation email. Your package must be accompanied by the original receipt purchase. For you to actually withdraw from the purchase contract, the following requirements should be met: the product should be in its original shape and should come in its original packaging with all the accompanying documents (receipt etc).

Regarding the return of the product to us, the shipping expenses is your responsibility and you are free to choose whichever delivery method is available to you. These expenses are not covered or reimbursed by Christiana Kafa. You will be reimbursed with the full amount of your order which includes the price of the purchased product and delivery expenses of your purchase (for orders outside Greece). We remind you that shipping in Greece is free of charge. For bank fees and additional charges imposed by a bank other than the collaborating banks with Christiana Kafa (Eurobank and Piraeus Bank), for the return of the paid amount, these bank fees and charges are not covered by Christiana Kafa.

All items are refunded at the price of the purchase. Items that were purchased during sales / offers period are refunded at the price of the purchase. The money will be refunded in the same way as it was received by us in the initial payment within 14 days from the day we received your return. If you choose to receive your refund in another way of that of the original charge, you will be responsible for any extra fees that may arise by that choice.

You will be notified for your refund with an email sent to your registered address with the following topic: “Your Christiana Kafa order has been refunded”.

If the above 14-day deadline is not met and if the product is not returned in its original condition, we will not accept the return nor will we reimburse the above stated amounts.

  1. EXCHANGES

We are unable to offer exchanges unless they regard wrong shipment and defective items. You can exchange any item within 14 days of receiving your original order. If you notice that your product is wrong or defective, let us know by sending us an email at [email protected]. This way we will expect the item from you and will prepare the exchange process. For us to accept the exchange, the product must be in its original condition, accompanied by the original receipt of purchase or the gift receipt and in its original packaging. All returns must be addressed to: Christiana Kafa, 21, Perikleous Str., 10563 Athens.

Concerning the exchange delivery charges, you can refer to the following situations:

– Wrong product

In this case, after we get back the product you mistakenly received in its original condition, we’ll send out the right one in a reasonable time from the delivery.  You will be reimbursed for all delivery charges with a deposit on the bank account that you indicate to us.

– Defective product

If you discover there is a flaw in your Christiana Kafa piece of jewelry within 14 days from delivery, we will replace or repair it with no extra charge (unless this is impossible or requires unjustified expenses on our behalf). You need to send the piece of jewelry at 21, Perikleous Str., 10563 Athens. We will send out a replacement as soon as possible. If the specific product is out of stock, you will be getting an e-mail informing you about the date of the delivery.

You will be reimbursed for all delivery charges with a deposit on the bank account that you indicate to us. This applies for our regular deposit and delivery charges and not express service or other courier providers of your choice. In this case you will be responsible for any additional charges.

  1. REPAIRS

All our handcrafted jewelry can be repaired. You can contact us and get en estimate on the cost of the repair beforehand and send your piece of jewelry back to our store (this delivery will come at your expense) at 21, Perikleous Str., 10563 Athens, accompanied by the original receipt of purchase or gift receipt and your contact details.

  1. DELIVERY OF UPON REQUEST PRODUCTS

For orders of products that are not in stock, we will charge your card for the full amount when the order is placed and we will we contact you as soon as possible to give you further information for the delivery days. Please note that the delivery date depends on the working production days that are required for the item to be created. We are unable to guarantee delivery dates due to unforeseen delays that might occur, however we will do our best to deliver your merchandise within the given timeframe.   1. INTELLECTUAL & INDUSTRIAL PROPERTY RIGHTS – TRADEMARKS

The intellectual property right is obtained without any formality and without any clause banning its offense being required. Our site’s content, which contains each and every trademark, distinctive mark, trade name, as well as graphics, photographs, design, text and logos, information material and data of any form, software and all HTML and other code contained in this site, constitutes intellectual and industrial property of the Christiana Kafa and is protected by the relevant provisions of Greek, European and International Law.

Pursuantly, any reproduction or redistribution of any kind (indicatively, transfer, distribution, resale, renting, republication, reproduction, electronic or mechanical broadcasting, save, print) of the above listed content is absolutely prohibited.

Our content does not constitute and shall not in any case be considered as express or implicit assignment of license or right of use of any Trademark appearing in it without our written consent or of any third party that may be proprietor of the Trademarks appearing in it. The trademarks, logos, distinctive marks appearing in this site and the display of persons, places or things that constitute part of its content, belong to the Christiana Kafa or to third parties. Their use is strictly prohibited without our prior written consent, unless otherwise provided for in the Terms & Conditions in force.

Products, services, trade names, trademarks or distinctive marks of third parties that appear in this site, constitute intellectual and industrial property of the third parties, who bear the relevant responsibility.

We do not promise that the functional aspects of the site or its content will be error free or that this site, the content or the server that makes it available are free of viruses or other harmful components and is not to be held accountable for any damages caused by such. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.

  1. LIABILITY OF CHRISTIANA KAFA

Christiana Kafa is not responsible for any loss, damages or costs that may arise from the use of or the incapability to use this site of any person, or referring to any inability to run, error, omission, interruption, defect, delay of operation or broadcast or system line fall. We are not responsible for any loss, damage or virus infection of the computer or of any other electronic means used by the user to access, visit, use or download material, data, text, images, video or sound from its content.

Christiana Kafa is strictly liable for the sold product’s defects or non-conformity with agreed qualities at the time the risk passes to the buyer, the knowledge of the latter releasing the seller from liability under conditions, together with other reasons for such a release provided by law.

The Services available through the site are provided to the users of the electronic shop “as they are”. The Company is not liable for any legal claims of civil or penal nature regarding the function or the use of this site, nor for any kind of damage caused either by visitors of the website or by third parties.

  1. CODE OF CONDUCT

Christiana Kafa is bound by the Code of Conduct for e-commerce [Decree 31619/15.3.2017] as in force.

  1. APPLICABLE LAW AND OTHER TERMS

The present terms and conditions as well as every amendment of them are governed by and interpreted according to the Greek law. If any provision is considered invalid or reversible, it expires ipso iure without the force of other terms being affected by this reason. In the event of any dispute associated with the use of this website, that dispute shall be subject to the exclusive jurisdiction of the courts of Athens.

Please also note that you have the right to access the Online Dispute Resolution (ODR) for all your online transactions. According to Directive 2013/11/EK, which was incorporated into Greek legislation by Joint Ministerial Decision 70330/2015, the option of online consumer dispute resolution is now available via the Alternative Dispute Resolution process throughout the European Union. If the customer has a problem with a purchase conducted through the Online Store and residing in the EU, he/she can use the ODR site for an out of court settlement.
